BACK TO THE FUTURE: The Musical Competition

Terms & Conditions

  1. Definitions
    1. In these Terms and Conditions, reference to:
      1. “Competition” means the Destination NSW x Back to The Future Musical Competition.
      2. “Entrant” means an eligible person who:
        1. Heads online to Back to the Future Link in NSW https://www.sydney.com/back-to-the-future-competition;
        2. Locates the Competition webpage;
        3. Completes the Competition entry form including answering “In 25 words or less, ‘If you could go back in time in Sydney what significant day would you go to and why?'” and confirmation of availability to travel on the Prize Dates; and
        4. Reads and accepts to be bound by these Terms and Conditions.
      3. "Entry Period” means from Tuesday 21st October 2025 9:00am (Sydney Time) to Tuesday 4th November 2025 5:00pm (Sydney Time).
      4. "Immediate Family Member" means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the Destination NSW employee.
      5. "Personal Information” means information or any opinion, whether true or not and whether recorded in a material form or not, about an identified individual, or an individual who is reasonably identifiable from the information or opinion and includes any information set out in Section 3 of the Promoter’s Privacy Policy (https://www.sydney.com/privacy)
      6. “Prize(s)” means the prize(s) set out in section 10 of these Terms and Conditions.
      7. “Prize Winner” means the Entrant who is judged as the Prize Winner as set out in section 7 to win the Prize as set out in section 10 of these Terms and Conditions.
      8. Promoter means Destination NSW (ABN 52 890 768 976) of Level 2, 88 Cumberland St, Sydney, NSW, 2000.
         
  2. General
    1. This Competition provides the opportunity for one (1) Prize Winner, to win a trip to Sydney for two (2) nights for the Prize Winner and one (1) guest. The prize includes two (2) x Category A tickets to Back to the Future: The Musical, two (2) x return economy airfares from the Prize Winner’s nearest airport to Sydney, two (2) x nights’ accommodation at Sheraton Grand Sydney Hyde Park for two (2) x people in the Back to the Future: The Musical room, including lounge access, buffet breakfast daily and pre-theatre dining for two (2),  meet and greet with the cast, DeLorean experience for one (1), one (1) x signed program, two (2) tickets to RELICS Discovery LEGO® exhibition at the Australian Museum.
    2. Prize Winner and their guests must be able to travel on the dates as stipulated by the Promoter and/or Competitions Partner. Travel must be taken prior to 31st January 2026 and the following black out dates do apply – 20th December 2025 – 3rd January 2026.
    3. Entries must comply with all of these Terms and Conditions to be valid.
    4. By registering for the Competition, the Entrant agrees to be bound by these Terms and Conditions.
    5. This Competition is a game of skill and chance does not play any element in this Competition.
    6. Any questions, comments or complaints can be directed to the Promoter at the details set out above in the definition section. 
       
  3. Participating countries
    1. Not applicable.
       
  4. Eligibility and entry conditions
    a. Entry into this Competition is free and open to residents of Australia who are 18 (eighteen) years of age or older. 
    b. Entrants acknowledge that if they are judged as Prize Winner, they must complete Prize travel on the dates provided by the Promoter. The Promoter reserves the right to determine travel dates at their absolute discretion. 
    c. A person who enters the Competition on behalf of another person does so on behalf of the other participant(s) and has the authority of the other participant(s) to enter this Competition. 
    d. The Promoter and the Competitions Partner reserve the right to request verification of age, identity, residential address of the Prize Winner and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. 
    e. The Promoter reserves the right to disqualify any individual who is deemed to be involved in any way in interfering or tampering with the conduct of this Competition in any manner.
    f. Any costs associated with accessing the website/application is the Entrant’s responsibility and is dependent on the internet service provider used. All costs incurred by the Prize Winner and their guests must be borne by the Prize Winner and their guests except for costs specified in the Prize description below.
    g. Employees of the Promoter, and/or its related companies and/or any agencies associated with the Competition, and their respective Immediate Family Members, are not eligible to participate in the Competition. 

 

  1. Format and structure
    1. To enter this Competition, you need to:
      1. Head online to Sydney.com, locate the Competition webpage; and
      2. Complete the Competition entry form including submitting in 25 words or less “In 25 words or less, your ‘If you could go back in time in Sydney what significant day would you go to and Why?'”; and
      3. Submit your form acknowledging that you have read the Promoter’s Privacy Policy and that you agree to receive marketing communications from Destination NSW including but not limited to the ‘Somewhere New’ database. Your information will not be provided to any other third party and you have the opportunity at any time to unsubscribe from any future communications from the Promoter.
    2. Each Entrant can only enter the Competition once throughout the Entry Period.
    3. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Terms and Conditions.
    4. Incomplete, ineligible or incomprehensible entries will be deemed invalid. 

 

  1. Cheating, abuse and disorderly behaviour
    1. Any Entrant may be disqualified from this Competition at the discretion of the Promoter for any failure to comply with these Terms and Conditions or cheating in any way such as:
      1. Using any cheats, hacks or other third party "helper" applications or “bots” to simulate human interaction; or
      2. Exploiting the application in any way or using the application in any way that circumvents the purpose and conditions of the Competition.
    2. Abusive behaviour, including any use of harassing, negative or profane language in Entrant submissions will not be tolerated and will also constitute grounds for immediate disqualification.

 

  1. Winner Judging
    1. The Competition is based on a game of skill where the best single (1) Prize Winner will be asked to ‘Tell us in 25 words or less, if you could go back in time in Sydney what significant day would you go to and why?'
    2. The best answer will be chosen based on being most descriptive, emotive and inspiring. The Promoter’s decision is final, and the Promoter is not required to correspond with any Entrants about these decisions.
    3. After the Promoter notifies the Prize Winners, all future correspondence will then be between the Prize Winners and the Promoter.
    4. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
    5. The Promoter reserves the right to disallow any entry and/or refuse to award a Prize where false or misleading details have been given by the Entrant. The Promoter also reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Competition. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. 

 

  1. Timings
    1. There will be one (1) Prize Winner Judged from Entrants who have entered during the Entry Period.
    2. The Prize Winners will be selected once all entries are evaluated based on the above criteria.
    3. The Prize Winner will be contacted by Wednesday 5th November 2025 11.59pm (Sydney Time).
    4. If the Prize Winner does not accept the Prize by Friday 7th November 2025 5:00pm (Sydney Time), the prize will be void.
    5. The Prize must be taken before 31st January 2026.  

 

  1. Prize Winner notification
    1. The Prize Winner will be notified following the evaluation by the email provided.

 

  1. Prize
    1. There is one (1) prize from a total prize pool estimate of $5,760 AUD (incl GST).
    2. The Prize is as follows:
      1. One (1) Prize Winner, to win a trip to Sydney includes two (2) x Category A tickets to Back to the Future: The Musical, two (2) x return, economy airfares from the Prize Winner’s nearest airport to Sydney, two (2) x nights’ accommodation at a Sheraton Grand Sydney Hyde Park for two (2) x people in the Back to the Future: The Musical room, including lounge access, buffet breakfast daily and pre-theatre dining for two (2),  meet and greet with the cast (subject to availability and change), DeLorean experience for one (1), one (1) x signed program, two (2) tickets to RELICS Discovery LEGO® exhibition at the Australian Museum.
    3. Entries must comply with all of these Terms and Conditions to be valid.
    4. The Prize Winner and their guests are responsible for any other incidental expenses as a result of using this Prize (including but not limited to meals, transfers, transport, spending money, and other experiences and attractions visited whilst in Sydney, insurance, bonds, taxes and travel expenses).
    5. The Promoter is not liable for any employment leave arrangements or arrangements for dependant family members i.e. annual leave payments, babysitting, carer arrangements.
    6. The Prize is subject to the conditions printed on the tickets and conditions of entry including dress code.
    7. You agree to comply with any reasonable directions of the venue.
    8. The Prize Winners and their guests must conduct themselves in a responsible, respectful and professional manner and comply with the conditions of the ticket and venue.
    9. The Prize will be provided to the Prize Winner as agreed between the Promoter and the Prize Winner.
    10. The Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. The Prize cannot be used to purchase gift certificates or lay-buys, nor can they be re-sold. The Prize must be taken as offered in clause 10(b). No modifications or exchanges will be possible. The Promoter accepts no responsibility for any variation in the value, performance or availability of any Prize.
    11. In the event that for any reason whatsoever a Prize Winner does not take an element of the Prize at the time agreed by the Promoter then that element of the Prize will be forfeited by that Prize Winner and cash will not be awarded in lieu of that element of the Prize.
    12. Once the Prize has been arranged by the Promoter, changes to the Prize must be made by and are at the expense of the Prize Winner.
    13. The Prize cannot be on-sold on auction websites, classifieds or by other method of re-sale.
    14. The Prize cannot be used for any other promotions/competitions. 

 

  1. Publicity release and use of Personal Information 
    a. The Promoter will collect information (including Personal Information) from all entries and use it for the purposes of the Competition and for its purposes. Entrants consent to the Promoter disclosing information, including Personal Information, to third parties for the purposes of the Competition. All Personal Information provided by Entrants will be held by the Promoter in accordance with Privacy legislation (including the GDPR for any information submitted by individuals in the European Union) and the Promoter’s Privacy Policy which is available at https://www.sydney.com/privacy. 
    b. By submitting an entry, Entrants agree to their entry being made available for public viewing.  Entrants acknowledge and agree that the Promoter may at any time, in its absolute discretion, remove, modify or not display entries submitted for this Competition. This includes (without limitation) any entry which (in the sole opinion of the Promoter) is defamatory, contrary to public standards of decency or otherwise judged to be inappropriate or offensive.   
    c. The Promoter is not responsible or liable in any manner for any content or materials posted in relation to this Competition. 
    d. By accepting the Prize, the Prize Winners and their guests consent to the Promoter using their details for promotional purposes.  
    e. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Competition. 
    f. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as a Prize. The Promoter is not liable for any loss suffered or sustained, to people or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by it, or its agents, in connection with the supply, or arrangement for supply, of any goods or services connected with this Competition.  
    g. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Entrants or Prize Winners and their guests (including but not limited to indirect or consequential loss), or for any personal injury (including death) suffered or sustained as a result of taking any Prize, except for any liability that cannot be excluded by law. 
    h. If this Competition is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Competition or to disqualify any individual who has tampered with the entry process.  
    i. Under Privacy law, Entrants may access Personal Information that the Promoter holds about them and seek correction of that information at any time. If Entrants no longer want the Promoter to notify them of initiatives that the Promoter considers may be of interest to them, they may notify the Promoter by email: info@dnsw.com.au. If Entrants choose this option, the Promoter will destroy any Personal Information that it holds about them.     j. Please note the tick box for your personal details to be shared with Sheraton Grand Sydney Hyde Park. https://www.marriott.com/about/privacy.mi 

 

  1. Exclusion of liability 
    a. By registering for this Competition each Entrant, Prize Winner and their guests assume sole liability for any personal injury and/or damage to property caused or claimed to have been caused to them as a result of or in connection with participating in this Competition. 
    b. These Terms and Conditions do not affect, and are not intended to affect, any rights or remedies a consumer might have which cannot be excluded under applicable consumer protection laws.  

 

  1. Governing law and jurisdiction
    1. These Terms and Conditions are governed by the laws of NSW, Australia and the parties submit to the non-exclusive jurisdiction of the courts of NSW for the resolution of any dispute, difference, controversy or claim arising in connection with these Terms and Conditions and/or this Competition.
